Persons of any age who are subject to a disability category must provide a package of medical documents and a referral for examination from a medical institution from the leading doctor who provided treatment. Disability is a persistent, long-term or permanent disability caused by a chronic disease or pathological condition (congenital defects of the cardiovascular system, osteoarticular system, hearing, vision, central nervous system, hematopoietic organs, etc.).
The term “disability” includes both legal and social concepts. The establishment of disability is followed by termination of work or changes in working conditions and the appointment of various types of state social security (pension, employment, vocational training, prosthetics, etc.), which is guaranteed by Soviet legislation.
The examination of long-term or permanent disability is carried out by medical-labor expert commissions (VTEK) (see Medical-labor examination).
The severity of disability can vary - from limited ability to work in the main profession to complete loss of ability to work in all types of professional activities.
Depending on the degree of loss or limitation of working capacity, the corresponding disability group is established - first, second, third.
The basis for establishing the first (1) disability group is such a violation of body functions, in which not only the ability to work is completely lost, but also there is a need for constant outside help, care or supervision.
The second (2) disability group is established in case of significantly pronounced functional impairments that do not cause the need for constant outside assistance, care or supervision, but lead to complete long-term or permanent disability or to a condition where certain types of work may be available to the patient only in specially created conditions.
The third (3) disability group is established for persons who, for health reasons, cannot continue to work in their main profession and in a profession of equivalent qualifications, as well as for persons who are not allowed to perform their work for epidemiological reasons (for example, pulmonary tuberculosis). At the same time, transfer to another job, reduction in the volume of work, or changes in the nature and conditions of work lead to a decrease in qualifications. The third disability group is also established for students with limited working ability and persons under 40 years of age who need to acquire a specialty, as well as limited working ability for persons with low qualifications or without a profession (for the period of training or retraining).
In order to dynamically monitor the course of the pathological process and the state of working capacity, systematic re-examination of disabled people is carried out in the manner established by the Regulations on VTEK. In a number of cases (the presence of pronounced anatomical defects, severe chronic diseases with irreversible changes), the disability group is established without specifying the period for re-examination.
In each case, when establishing disability, VTEK determines one of the following causes: disability due to a general illness, occupational disease, work injury, disability since childhood, disability before starting work. In accordance with this, state legislation of the USSR establishes different amounts of pensions and the nature of other types of social assistance (see Social Security). Disability indicators provide an idea of how morbidity, injury and other health problems affect the working ability of the population. The following disability indicators are of greatest importance: a) intensive indicator of primary disability; b) the severity of the disability; c) distribution of those newly recognized as disabled by age groups; d) the proportion of those recognized as disabled for the first time according to certain nosological forms; e) indicators of restoration of working capacity. Disability indicators reflect the quality of healthcare organization, the effectiveness of treatment and prevention; the state of labor protection at industrial enterprises, state farms, collective farms and other factors of a socio-economic nature.
Measures to prevent disability are the prevention of morbidity and injury, timely started, comprehensive, fully completed treatment, measures for the timely and rational employment of long-term ill people (see Employment), improvement of working conditions and labor protection for workers.
Visual disability is issued to citizens who not only have poor vision, but also have no chance of significantly improving their vision in the near future. At the same time, the reasons why vision has decreased so much are not important, whether it is a consequence of an injury or a manifestation of congenital malformations of the eyeball. For all cases, a uniform procedure for registering disability has been established.
A disabled person is a person with health problems caused by various reasons. Moreover, such violations limit life activity, as a result of which a person begins to need outside help. Limitation of life activity can be expressed in various forms; a disabled person may not be able to take care of himself at home or provide for himself financially.
Visual disability is given to persons who have completely lost their vision, or their ability to see the world around them is so small that it does not help them cope at home and at work without outside help. There are many reasons for complete or partial blindness; these can be congenital defects, various dysfunctions of the eyeball acquired with age, and, of course, injuries.
It is very rare that blind people can lead a normal life. The usual crossing of the road is already problematic for them. Although in most cases they do not have other problems with health and mental activity, the limitation of their life activity is manifested in the inability to perceive the visual component of what is happening around them. Visually impaired people need special means to obtain information. For example, books with a special font; computer programs that read out what is written on the screen, together with a special keyboard; pedestrian crossings equipped with sound signals.
Therefore, the state is introducing a number of social and economic programs that allow visually impaired people to participate in the life of society on an equal basis with healthy citizens. At the legislative level, this is ensured by the adoption of regulations, such as the Federal Law “On Social Protection of Disabled Persons in the Russian Federation” No. 181-FZ of November 24, 1995.
And on September 24, 2008, Russia signed the Convention on the Rights of Persons with Disabilities in New York, which was ratified on May 3, 2012 by Federal Law No. 46-FZ. After which the legislation of the Russian Federation began to be brought into line with international standards, which should subsequently lead to the introduction of mechanisms that serve to facilitate the life of people with disabilities.
In addition to the Federal Law “On Social Protection of Disabled Persons in the Russian Federation,” which reveals the basics of the procedure for assigning disability, the Government of the Russian Federation adopted Resolution “On the procedure and conditions for recognizing a person as disabled” No. 95 of February 20, 2006. These approved rules list the following conditions under which a visually disabled person is officially recognized as such:
It is worth noting here that the concept of “habilitation” appeared in legislation after the ratification of the convention. And changes to national legislation, where habilitation measures are added to rehabilitation measures, will come into force on January 1, 2016. This concept is deciphered as follows: habilitation is the process of developing in a disabled person the missing skills for social and work activities. While rehabilitation implies the restoration of such skills.
Characteristic is the fact that in order to recognize a person as disabled, at least 2 of the above conditions must be met. It turns out that simply having blindness is not enough for a person to become visually disabled ; he must also either be limited in his life activities or need help from the state. But proving these facts to experts who decide to assign a visual disability may not be so easy.
It should be noted right away that determining the group of visual disability is the prerogative of an ophthalmologist. Of course, there are developed uniform methods for determining the severity of vision loss. But only a doctor can make a diagnosis. Therefore, if a person does not agree with the experts’ decision, then before starting legal disputes, it is necessary to confirm or refute the diagnosis from another ophthalmologist.
But approximately, the following regulations can be applied to give an idea of the distribution by disability groups:
Disability due to cancer
A disability group is necessary for a person who, due to illness or treatment, has suffered significant harm to his health and has lost his ability to work to varying degrees. Social support, which is guaranteed to a cancer patient, allows him to quickly adapt and continue a normal life in conditions that suit his condition. Each cancer patient can undergo the necessary examination and submit an application to the Bureau of Medical and Forensic Examination (BMSE) to determine the disability group.
Registration of disability for cancer is possible 3 months after the start of treatment. The attending physician, who should be aware, usually helps to understand this issue. During the treatment process, you can begin to collect the necessary documentation and information on this issue. The role of the oncologist in this is significant, since it is necessary to draw up all extracts, examination results and conclusions. The oncologist also issues a special mailing list, with which the patient is subsequently sent for a full examination. The main document will be the result of examination and treatment by an oncologist, but in parallel it is necessary to enter data on concomitant diseases. It is mandatory to take urine, blood and stool tests.
When all the documents are ready and the mailing list is completed, the main oncological diagnosis is certified by the chief physician.
The results of the X-ray and histological examination and the conclusion of the main diagnosis are transferred to the Bureau of Medical and Social Expertise. BMSE is the body that deals with registration of disability; you must first submit an application for consideration of this issue.
The service is contacted at the place of residence after 3-4 months from the start of cancer treatment.
Factors influencing the decision of the BMSE
Appeals to the BMSE for cancer patients do not always end in success; this is due to ignorance of the rules for filing an application and the possibility of registering disability for certain individuals. The main criterion by which the decision will be made is the organ affected by the cancer process and the degree of the disease. It is important to provide information about the treatment, what methods and how long the course of therapy took to make a decision. Disability is mainly granted to persons who have lost their legal capacity and cannot return to their previous place of work. For example, a patient who has been treated for skin cancer can fully perform his duties at work, but diseases of internal organs pose a danger to the patient, and the possibility of disability is much higher.
Also, the design of the group is influenced by the location of the tumor process in the organ, the form of the disease, the volume and progression of growth, as the basis for the prognosis. You can obtain all this data from your attending physician, who also makes a prognosis for the disease. Some oncological pathologies require ongoing treatment or staged operations, all of this is also taken into account and affects the receipt of the group. The oncologist also describes how surgical interventions are carried out and with what frequency.
Conducting radiation therapy and chemotherapy as additional treatment still remains a controversial issue in decision-making. Most experts are inclined to believe that the introduction of anticancer drugs during treatment should be taken into account when receiving an oncology group.
The first step of the BMSE is to determine the group to which a specific course of cancer fits. The service is based on medical reports and treatment time. In case of malignant cancer, disability due to oncology is issued to the person for life, and this is controlled by special bodies, since a list of diseases has been created for which disability is determined until the end of life.

In case of a malignant process of the brain, temporary disability is established for up to 3 months, that is, for the period of examination. When treated with radiation, as an additional or primary measure, the period is extended to 4 months, and if the prognosis is unfavorable, the issue of registering disability is considered. The patient undergoes all examinations and submits an application to the BMSE no later than 4 months after the start of treatment.
In case of a thyroid tumor, the average duration of temporary disability is up to 4 months in the case of surgical measures.

After surgery for scoliosis in 2009, my daughter was given disability group 2, in 2010 group 2 was changed to group 3 and they were told that in 2011 the disability would be removed. She can sit for 20 minutes at a time, the scoliosis has not been cured, the metal structure is in place. The pain continues. In 1993, I was diagnosed with “BRONCHIAL ASTHMA” and was assigned disability group 2. One year later, I was given group 3, why they didn’t explain, well, I think it should be so, but recently I met with an allergist and she was surprised that I had this problem The diagnosis was 3g.
